By accessing or using CakeSplit (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CakeSplit is an AI-powered tool that extracts, segments, and layers game UI assets from images. Features include asset detection, background removal, style generation, and export to design tools such as Figma, Photoshop, and Unity.

3. Eligibility

You must be at least 16 years old to use the Service. By using CakeSplit you represent that you meet this requirement.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must promptly notify us of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Credits & Payment

• Certain features consume credits from your account balance.
• Credits are non-refundable except where required by applicable law.
• Credit packages purchased are associated with your account and are non-transferable.
• We reserve the right to adjust pricing and credit costs with reasonable notice.

6. Acceptable Use

You agree not to:

• Upload content that infringes third-party intellectual property rights.
• Use the Service to process illegal or harmful content.
• Attempt to reverse-engineer, decompile, or extract our AI models.
• Use automated scripts or bots to bulk-process content beyond intended use.
• Attempt to circumvent usage limits or billing.

7. Intellectual Property

Your content: You retain ownership of all images and assets you upload. By uploading, you grant CakeSplit a limited, non-exclusive licence to process your content solely to provide the Service.

Our technology: CakeSplit, its AI models, UI, and codebase are the intellectual property of CakeSplit. You may not copy, redistribute, or commercially exploit our technology without written permission.

Third-party trademarks: Figma, Adobe Photoshop, Unity, and Godot are trademarks of their respective owners. CakeSplit is not affiliated with, sponsored by, or endorsed by any of these companies; they are referenced solely to describe supported export formats.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE PERFECT RESULTS. AI-GENERATED AND AI-ASSISTED OUTPUTS (INCLUDING DETECTED ASSETS, STYLE VARIATIONS, AND RECONSTRUCTED BACKGROUNDS) MAY CONTAIN INACCURACIES AND SHOULD BE REVIEWED BEFORE COMMERCIAL OR PRODUCTION USE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAKESPLIT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PRECEDING 3 MONTHS.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

12. Changes to Terms

We may update these Terms. Continued use of the Service after changes constitutes acceptance of the new Terms. We will provide 14 days' notice of material changes.
